Blended Family Challenges

A second marriage brings two families together—and creates unique legal challenges. A married couple with children from prior marriages came to us seeking direction. They had no prenuptial agreement, but they shared a plan for handling expenses and wanted to prevent future disputes among their heirs.

We structured a specific plan to protect both the surviving spouse and their respective children:

  • Reciprocal Wills: Provided legal structure and support for each spouse.

  • Personal Property Memorandum: Designated specific heirlooms and possessions directly to their own children.

  • Direct Beneficiary Designations: Retained their children as primary beneficiaries on some individual investment accounts, bypassing the will entirely.

No single plan fits every mature family, and updates are necessary as life changes. By addressing these choices head-on, this couple eliminated confusion and spared their children from sorting out an unplanned estate.
